Creating an Account

To use certain features of the Website, you are required to approach the associated pathology laboratories of Medata with a request to upload your reports, information, data on the Website. Once your information, data, reports are uploaded by the concerned associated pathology laboratory, the Website will auto generated your login credentials in an encrypted format. The login credentials will be sent to you on the mobile number as well as your email address as provided by you to the concerned pathology laboratory. All of your information is protected by our Privacy Policy. You represent and warrant that the information you submit during registration is accurate and that you will maintain the accuracy of such information. Your Medata Account username and password are personal to you. You may not transfer your account and you will be responsible for the activities associated with your Medata Account. Medata will not be liable for any loss or damages as a result of your failure to maintain the confidentiality of your account credentials. If you suspect any unauthorised use of your Medata account, you shall immediately notify Medata.com. It is your responsibility to keep your email address up-to-date on your account setup at www.medata.in so that we can communicate with you electronically.

Your personally identifiable information will be used in accordance with our Privacy Policy. To understand our practices, as to how we collect, use and disclose your personally identifiable information, please adhere to our Privacy Policy, which also governs your visit to www.medata.com. The results of any search Users perform on the Website for Pathology laboratories or Practitioners should not be construed as an endorsement by Medata of any such particular Practitioner of Pathology Laboratories. If the User decides to engage with a Practitioner of any Pathology Laboratory to seek medical services, the User shall be doing so at his/her own risk.

Without prejudice to the generality of the above, Medata is not involved in providing any healthcare or medical advice or diagnosis and hence is not responsible for any interactions between User and the Practitioner or the Pathology Laboratory. User understands and agrees that Medata will not be liable for:

i. User interactions and associated issues User has with the Practitioner or Pathology Laboratory.

ii. the ability or intent of the Practitioner or Pathology Laboratory or the lack of it, in fulfilling their obligations towards Users.

iii. any wrong medication or quality of treatment being given by the Practitioner or Pathology Laboratory, or any medical negligence on part of the Practitioner(s) or Pathology Laboratory.

iv. inappropriate treatment, or similar difficulties or any type of inconvenience suffered by the User due to a failure on the part of the Practitioner(s) or Pathology Laboratory to provide agreed Services.

v. any misconduct or inappropriate behaviour by the Practitioner or the Practitioner’s staff or Pathology Laboratory; vi. cancellation or no show by the Pathology Laboratory or Practitioner or rescheduling of booked appointment or any variation in the fees charged.

FREE SERVICE

User agrees, acknowledges and understands that the services being offered through the Website to an extent of storing and making the information, data and report accessible / available online is a completely free service and no liability can be fastened on Medata for any deficiency in service as per Consumer Protection Act, 1986. However, Medata reserves right to provide such services on chargeable basis solely at its discretion on prior intimation to the Users through emails and mobile numbers registered with Medata.

Use of Information on the Website

The information provided on the Website or through our services is intended for convenience of the Users to access information, data and reports online, and not intended to diagnose, treat, cure or prevent any disease. If any provision of these Terms and Conditions shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms and Conditions and shall not affect the validity and enforceability of any remaining provisions.

You agree that Medata, in its sole discretion and for any or no reason, including without limitation if you breach these Terms and Conditions, may terminate your access to and use of the Website, at any time. You agree that any termination of your access to the Website or suspension of your account may be effected without prior notice, and you agree that Medata om shall not be liable to you for any such termination.
